1. Agreement to Terms
By accessing or using PingRadar ("Service"), operated at pingradar.online, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Description of Service
PingRadar is a website and API monitoring platform that provides uptime monitoring, SSL certificate monitoring, domain expiry tracking, DNS monitoring, status pages, alerting, and related services. The Service is available via web browser and API.
3. Account Registration
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the security of your account credentials
- You must be at least 16 years old to use the Service
- One person or organization may maintain multiple accounts only with separate email addresses
- You are responsible for all activity that occurs under your account
4. Acceptable Use
You agree not to use the Service to:
- Monitor websites or services you do not own or have authorization to monitor
- Conduct denial-of-service attacks, port scanning, or vulnerability testing via our monitoring infrastructure
- Send unsolicited notifications, spam, or abuse alert channels
- Circumvent rate limits, plan restrictions, or security measures
- Use the Service to facilitate illegal activity
- Resell or redistribute the Service without written permission
- Overload the Service infrastructure with excessive API calls beyond reasonable use
5. Plans and Billing
Free Plan
The Free plan provides limited access to the Service at no cost. We reserve the right to modify Free plan limits at any time with reasonable notice.
Paid Plans
- Paid subscriptions are billed monthly or annually in advance via Paddle, our merchant of record
- Prices are listed in USD and may be subject to applicable taxes (handled by Paddle)
- You can upgrade or downgrade your plan at any time; changes take effect at the next billing cycle
- Paddle manages all payment processing, invoicing, and tax compliance
Cancellation and Refunds
- You may cancel your subscription at any time from your account settings
- Upon cancellation, your paid plan remains active until the end of the current billing period
- After the billing period ends, your account reverts to the Free plan
- We do not offer prorated refunds for unused portions of a billing period
- Refund requests for exceptional circumstances may be submitted to support@pingradar.online
6. Service Level
We strive to maintain high availability of the Service but do not guarantee 100% uptime. The Service is provided on an "as is" and "as available" basis. We are not liable for any damages arising from Service downtime, monitoring delays, or missed alerts.
Monitoring checks are performed at the intervals configured in your account. Actual check timing may vary slightly due to system load. Alert delivery depends on third-party services (email providers, Telegram, Slack, etc.) and is not guaranteed.
7. Intellectual Property
- The Service, including its design, code, and content, is owned by PingRadar
- You retain ownership of your data (monitored URLs, configuration, check results)
- You grant us a limited license to use your data solely to provide the Service
- Status pages you create may be publicly accessible; you are responsible for their content
8. API Usage
- API access is subject to rate limits based on your plan tier
- API keys must be kept confidential; compromised keys should be rotated immediately
- We reserve the right to throttle or suspend API access for abuse
- API responses are for your use only and may not be cached or redistributed at scale
9. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.
10. Limitation of Liability
To the maximum extent permitted by law, PingRadar and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, revenue, or data
- Damages arising from Service downtime or monitoring failures
- Damages from missed or delayed alerts
- Damages from unauthorized access to your account
Our total liability for any claim related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless PingRadar from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
12. Termination
- You may delete your account at any time, which will remove your data within 30 days
- We may suspend or terminate accounts that violate these Terms
- We may terminate the Service with 30 days' notice to active users
- Upon termination, your right to access the Service ceases immediately
13. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or a notice on the Service. Continued use after changes constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of competent jurisdiction.
